Fairfield man arrested for sexual abuse

FAIRFIELD — A Fairfield man was arrested Wednesday and charged with third degree sexual abuse.
David Michael Phipps, a Fairfield resident who is listed as “homeless” in his arrest record, was placed under arrest for an incident that occurred Sunday, May 21 while he was riding in a vehicle between Libertyville and Fairfield.
According to his arrest report, Phipps allegedly performed sex acts on a person who was riding in the car with him and who was also intoxicated. Phipps allegedly told police that the sex acts were consensual. The arrest report states that two witnesses in the vehicle provided statements affirming that the sex acts occurred, and that the victim was intoxicated. Phipps was charged with performing a sex act on a victim who was mentally incapacitated and incapable of providing consent.
Phipps’s charge for sexual abuse in the third degree is a Class C felony. It is a forcible felony under Iowa State, and carries a maximum sentence of 10 years in prison.
Iowa Courts Online shows that Phipps had been arrested the prior week on May 16 for trespassing at Everybody’s Whole Foods in Fairfield after he was told not to return. Phipps pleaded guilty to trespass, and agreed to pay a fine of $260 and other court costs. At the time of his arrest for trespassing, Phipps listed his place of residence as Sacramento, California.
