Fairfield man receives five-year sentence for lascivious acts with child

FAIRFIELD – A Fairfield man has pleaded guilty to a charge of lascivious acts with a child, and has been sentenced to five years in prison.
Timothy Sebastian 'Chavo” Chavez, 21, first pleaded not guilty to the charge but changed his plea to guilty on Aug. 12. Authorities planned to take Chavez to the Oakdale Medical Classification Center for intake into the Department of Corrections. He will be subject to a 10-year 'special sentence” for sex offenders as provided by law, and will be required to participate in the Sex Offender Treatment Program.
According to a news release from the Jefferson County Attorney's Office, Chavez had been convicted in Jefferson County of lascivious conduct with a minor, a serious misdemeanor, in March of 2017.
'Based on his prior conviction and the admissions he made relating to this most recent incident, Mr. Chavez is a
sexual predator with a demonstrated history of targeting children,” stated the news release. 'The court's sentence of prison will ensure the safety of the public in Jefferson County, as well as provide Mr. Chavez an opportunity to recidivate and reform his predatory behavior.”
Chavez was arrested April 20, 2019, and charged with lascivious acts with a 13-year-old girl. According to an arrest report from the Fairfield Police Department, officers were notified by the 13-year-old's mother that her daughter had been at a party and that the mother was looking for her.
The mother reported that, while searching for her, she found her daughter behind Boom Fitness, naked, with a man on top of her who was also naked. The mother told police that the man put his clothes on and ran away.
Officers spoke to the girl, who said she had been drinking, blacked out, and did not remember what happened. Officers spoke to another witness who gave the same account of events as the mother.
Officers checked the area in search of the man, whom they located laying by the railroad tracks in an attempt to hide. According to the arrest report, the man was apprehended after a short foot chase. Both witnesses picked the defendant out of a photo lineup.
