Prosecutors want a judge to bar defense lawyers from using the constitutional rights to free speech as a defense for Occupy Iowa protesters charged with trespassing at the state Capitol in Des Moines.
The Des Moines Register reports that prosecutors say the judge assigned to Monday?s scheduled trial of protesters Hugh Espey and David Goodner should not let jurors consider whether those rights justify disobedience to trespassing laws.
On March 9, former state Rep. Ed Fallon was acquitted of trespassing at the Capitol on Oct. 9. One juror said the decision was a matter of putting the U.S. Constitution above a state-imposed curfew.
