DES MOINES ? A Kalona man has been convicted on four counts of making false claims to the Internal Revenue Service (IRS). United States Attorney Nicholas Klinefeldt announced that James Lavon Miller, 62, was convicted of the tax offenses Monday. Miller waived his right to a jury trial and was tried before U.S. District Judge John A. Jarvey.
Miller was convicted based on false tax returns he filed in 2008 and 2009 corresponding to the 2005, 2006, 2007 and 2008 tax years. Klinefeldt said in the press release that Miller knowingly listed false amounts of interest income and federal withholding in his returns and claimed millions of dollars of tax refunds to which he was not entitled. Miller?s sentencing date has not been sent. He will be held in custody until then.
The Criminal Investigation Division of the IRS investigated the case. The U.S. Attorney?s Office for the southern district of Iowa prosecuted the case.
